1. Scope and conditions of application
These terms & conditions are applicable to any
order submitted via the site www.casadisagne.com
Casadisagne
reserves the right to change these terms & conditions at any
time. In this event, the current terms & conditions will be
applied to each order.
Any customer having submitted an order on
casadisagne.com is considered de facto to have accepted the
current terms & conditions without restriction.
2. Products presentation
Casadisagne
can not be held liable for any possible mistakes in the product
descriptions. Photographs are not part in the contract.
3. Products Prices
Our prices are stipulated in euros,
net of VAT tax, ex-factory, packing included. Goods will always
correspond to those into force at the time of the order by our
company.

Any order lower
than 300 € net VAT excl. will be subject to flat rate fee in the
amount of 15€ VAT Excl. and will be paid on pro-forma invoice.
Casadisagne
reserves the right to refuse to honour a customer’s order if a
previous order has not been fully or partially settled, or where
there is dispute over payment.
5. Terms of payment
Except
contrary stipulation, our invoices are payable in Eygalières
(France) only by bank transfer on pro-forma invoice, and
without discount. All bank expenses remain at the client’s
charge.
According
to French Law 2001-40 dated 15/05/01 known as "law NRE": in
the absence of payment of our invoices in the specified term,
CASADISAGNE will apply penalties at the rate of the European Central
Bank (B.C.E) increased by 7 points, with a minimum invoicing of 10 €
Vat Excl.
In the absence of
payment of one single invoice, all other invoices will become full
and immediately payable.
Besides
the penalty of delay, expenses caused by the collection of the unpaid
invoices will be supported by the customer who will be indebted to a
flat fee, following a registered demand remained fruitless, fixed to
20 % of the due sums, with a minimum of 80 euros Vat Excl.
6. Shipping and Delivery
In the event of
delivery non in conformity or prone to litigation, any reserve will
have to be formulated precisely on receipt of the conveyor and will
have to be followed within 48 hour as from the delivery by a
registered letter with acknowledgement of delivery addressed to the
conveyor, copy being forwarded to CASADISAGNE.
Only the recipient
exerts his recourse against the conveyor in the event of delays,
lacks and/or damages.
Except contrary
stipulation, it will fall to the purchaser to ensure the expenses and
the risks of the transport of the sold goods, subsequently to the
delivery.
Any
delivery delays compared to the indicative times of delivery
initially envisaged, will not give place to penalty or allowance, nor
justify the cancellation of the order to CASADISAGNE.

7. Guarantees
The goods sold by
CASADISAGNE are guaranteed against all apparent defects and/or of
operation coming from a defect of material, manufacture or design
under the conditions below:
- the apparent defect will have to be denounced to CASADISAGNE at the time of the reception of the product,
- the vice, one of possible operation will have to appear and to be
immediately denounced to CASADISAGNE within 30 days as from the
delivery, for a use of the good in conformity with its destination
and its nature.
CASADISAGNE
responsibility is expressly limited to the guarantees and reserves
above mentioned, and will not be looked after nor committed because
of incidents and/or accidents caused to people or things in the event
of abnormal installation and/or of use not in conformity with the
destination or nature of our goods.
Dimensions of our
designs are given only as an indication. CASADISAGNE reserves the
right to modify its designs at its discretion.
8. Sale abroad
The
products we sell comply with electrical norm NF EN 60598-2-1 for the
wall lights and ceiling lights and NF EN 60598-2-4 for the other
lamps.
However,
Casadisagne may not be held liable if the products violate the
legislation of a foreign country to which the products are delivered.
It is the customer’s responsibility to check with local
authorities on the possibility of importing or using the products
ordered.
9. Reserve of the right of Ownership
CASADISAGNE preserves
the property of the goods sold until the effective payment of the
full price in the main thing and accessory.
Non-payment
of one of the terms will allow CASADISAGNE to claim for the goods
concerned.
10. Intellectual property
The
texts, illustrations and images reproduced on the site
casadisagne.com are reserved worldwide by copyright and
intellectual property right.
As
such, and in accordance with the provisions of the Intellectual
Property Code, only private use is authorized, subject to different
and more restrictive provisions of said code. Any complete or partial
reproduction of the site casadisagne.com is prohibited.
11. Processing of personal and confidential data
Your
personal information (identity, address, e-mail address, telephone
number) are not sold or given to any third party without your
consent. www.casadisagne.com has submitted its declaration to
the CNIL (National Commission on Information Technology and Freedom)
under number 117 12 53. Our declaration to the CNIL guarantees your
rights, which are fourfold:

12. Attribution of Jurisdiction
In the event of
litigation of any nature the court of Tarascon on Rhone will be
